These Terms of Service ("Terms") govern your use of the TurkeyStemcell website, consultation requests, and all clinical and non-clinical services provided by TurkeyStemcell ("Clinic," "we," "us," or "our"). By accessing our website, submitting information, engaging our services, or making payment, you confirm that you have read, understood, and agreed to these Terms in full. If you do not agree, you must not use our services.

1. Nature of Our Services

TurkeyStemcell is a regenerative medicine clinic operating in Istanbul, Türkiye, under Turkish healthcare regulations. Our services include:

  • Medical consultation and suitability review.
  • Stem cell therapy, exosome therapy, IV vitality protocols, and related regenerative procedures.
  • Pre-treatment evaluation, in-clinic procedures, and post-procedure instructions.
  • International patient coordination, including scheduling, travel logistics, and translation support.

All clinical care is performed by licensed physicians under physician supervision and in compliance with Turkish healthcare law.

2. Jurisdiction of Services

All medical procedures are performed exclusively in Türkiye and are governed solely by Turkish law and Turkish healthcare regulations. Regulatory approvals from foreign authorities (including FDA, EMA, MHRA, TGA, Health Canada, or others) do not apply to treatments performed in Türkiye. Patients acknowledge that treatment availability, protocols, and regulations may differ from those in their home country.

3. Experimental Status & Regulatory Disclosure

Certain regenerative medicine treatments offered at TurkeyStemcell may be considered experimental or investigational in some jurisdictions. By engaging our services, you acknowledge and agree that:

  • These treatments may not be approved, licensed, or recognized in your home country.
  • No statements on this website have been evaluated by the U.S. Food and Drug Administration (FDA).
  • No statements on this website have been evaluated by the European Medicines Agency (EMA).
  • No statements on this website have been evaluated by the UK MHRA or any other foreign regulatory body.
  • Treatments are not marketed as cures for any condition.
  • All procedures are performed in compliance with Turkish healthcare regulations.
  • You have conducted your own research and due diligence regarding the nature of the treatments.

4. No Guarantee of Outcomes

4.1 Individual Variation

Biological responses to regenerative medicine vary significantly between individuals. Results depend on factors including age, disease severity and progression, immune response, overall health, lifestyle, genetic factors, and adherence to pre- and post-treatment instructions.

4.2 No Warranty

TurkeyStemcell and its treating physicians:

  • Do not guarantee outcomes of any procedure or treatment.
  • Do not promise specific improvements in any condition.
  • Do not claim to cure any medical condition.
  • Do not warrant that any particular treatment will be suitable for any patient.

No medical procedure guarantees success. No representation made on our website, in our communications, or by our staff should be interpreted as a guarantee or promise of any specific medical outcome.

5. Assumption of Risk

All medical procedures involve inherent risks, including but not limited to:

  • Inflammation, swelling, pain, or discomfort.
  • Infection or allergic reaction.
  • Lack of improvement or worsening of condition.
  • Unforeseen complications or adverse events.
  • Risks associated with international travel.
  • Differences in medical standards, language, and regulatory frameworks between countries.

By proceeding with treatment, you voluntarily assume these risks. Informed consent for any procedure is obtained directly from the treating physician at the clinic prior to the procedure.

6. Patient Obligations

By engaging our services, the patient agrees to:

  • Provide accurate, complete, and truthful information about medical history, current conditions, medications, and allergies.
  • Disclose all relevant medical information that may affect treatment eligibility or safety.
  • Follow all pre- and post-treatment instructions provided by the treating physician.
  • Inform the clinic promptly of any complications, side effects, or new symptoms.
  • Obtain informed consent directly from the treating physician before any procedure.
  • Arrive on time for scheduled appointments and confirm travel arrangements in advance.
  • Provide at least 48 hours' notice for any cancellation or rescheduling.
  • Accept that treatment eligibility and scheduling are subject to the treating physician's clinical judgment.

Failure to provide accurate and complete information may affect eligibility, outcomes, and the clinic's responsibility.

7. Fees, Payment, and Billing

7.1 Treatment and Service Fees

Fees for consultation, treatment, and related services are communicated and agreed upon before services are rendered. Quoted prices may exclude third-party costs such as accommodation, flights, or external diagnostics, which are billed separately.

7.2 Advance Payment and Deposits

A deposit or full payment may be required to confirm scheduling, particularly for treatments that require advance preparation of biological materials.

7.3 Biological Material

Certain treatments (such as stem cell and exosome therapies) involve patient-specific, time-sensitive biological materials that are prepared in advance. Once such materials have been ordered or prepared for a scheduled treatment, related fees become non-refundable, as the material cannot be reused for another patient.

8. Cancellation Terms

  • Cancellations made more than 7 days before the scheduled treatment may be eligible for partial credit toward a future treatment date, at the clinic's discretion.
  • Cancellations made less than 48 hours before the scheduled treatment, or no-shows, may forfeit the deposit and any prepared biological material fees.
  • Lack of desired clinical results does not constitute grounds for refund of services already rendered.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

TurkeyStemcell's total liability for any claim arising out of or related to our services is limited to the amount actually paid by the patient for the specific service giving rise to the claim. We are not liable for:

  • Indirect, incidental, consequential, special, or punitive damages.
  • Loss of income, data, opportunity, or other intangible losses.
  • Travel, accommodation, or third-party service expenses.
  • Acts, omissions, or failures of third-party providers (hotels, airlines, transfer companies, external laboratories).
  • Emotional distress or dissatisfaction with medical outcome.
  • Outcomes that fall within the range of recognized clinical variation and risk.

10. Force Majeure

TurkeyStemcell is not responsible for delays, cancellations, or failure to perform services due to circumstances beyond our reasonable control, including but not limited to airline disruptions, visa denials, political instability, government restrictions, natural disasters, severe weather, pandemic-related restrictions, or provider unavailability due to events beyond our control. Refunds are not automatically granted in force majeure situations. Each case is evaluated individually based on the work already performed and material already prepared.

11. International Patients

Patients traveling from outside Türkiye acknowledge that:

  • All treatments are performed exclusively in Türkiye and governed by Turkish law and Turkish healthcare regulations.
  • Foreign regulatory standards, approvals, or legal frameworks do not apply to treatments performed in Türkiye.
  • International medical travel involves inherent risks, including travel disruptions, visa issues, and differences in medical standards, which the patient voluntarily accepts.

12. Dispute Resolution

In the event of any dispute arising from or related to these Terms or our services, you agree to first contact us at info@turkeystemcell.com to attempt resolution through good-faith negotiation within thirty (30) days. If a dispute cannot be resolved through negotiation, it shall be resolved through the appropriate legal channels under the governing law specified below.

13. Governing Law & Jurisdiction

These Terms, and all clinical and commercial services provided by TurkeyStemcell, are governed exclusively by the laws of the Republic of Türkiye. All disputes shall be resolved exclusively by the competent courts of Istanbul, Türkiye.

14. Indemnification

You agree to indemnify, defend, and hold harmless TurkeyStemcell and its officers, employees, physicians, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from or related to: (a) your use of our services; (b) your breach of these Terms; (c) any inaccurate or incomplete information you provide; (d) your failure to follow medical instructions provided by your treating physician; or (e) your interactions with third-party service providers introduced through our services.

15. Severability

If any provision of these Terms is found invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable while preserving its intent.

16. Entire Agreement

These Terms, together with our Privacy Policy and Medical Disclaimer, constitute the entire agreement between you and TurkeyStemcell regarding your use of our website and services. No oral or written representation outside of these documents shall be binding.

17. Modifications

We reserve the right to amend these Terms at any time without prior notice. The most current version is always available on our website with an updated revision date. Continued use of our services after any modification constitutes acceptance of the updated Terms.
